User Agreement.

Acceptance of This Agreement

By accessing or using any Warke Technologies website, product, hosted service, demonstration environment, digital asset, communication channel, or related service, you agree to comply with this User Agreement and any other terms, licences, policies, or contractual documents applicable to the relevant service.

Eligibility & Authority

You represent that you have the legal capacity and authority required to enter into this Agreement and use our services.

• If you act on behalf of a company or organization, you represent that you are authorized to bind that organization where applicable.
• You must comply with any age, regulatory, contractual, or legal requirements applicable to the relevant product or service.
• You must not access services if doing so would violate applicable law or a binding legal restriction.

Accounts, Credentials & Access Security

Where a service requires an account, login, API key, password, access token, or other credential, you are responsible for protecting those credentials and preventing unauthorized use.

• Keep access credentials confidential and secure.
• Do not share credentials except where expressly permitted.
• Notify us promptly if you become aware of unauthorized access or suspected compromise.
• You remain responsible for activity performed through your account where legally appropriate.

Access to Services & Digital Resources

Subject to applicable terms and any required payment, Warke Technologies may provide access to websites, demos, applications, source-code packages, hosted services, APIs, documentation, software tools, or other digital resources.

Access may be limited by licence scope, subscription status, payment status, usage restrictions, technical availability, geographic limitations, or security controls.

Software, Product & Licence Rights

Unless ownership is expressly transferred in a separate written agreement, software, templates, applications, source code, documentation, designs, frameworks, and digital assets are licensed rather than sold.

• Use is limited to the rights expressly granted under the applicable licence or purchase terms.
• You may not resell, sublicense, redistribute, publish, or commercially exploit licensed materials unless expressly permitted.
• Third-party and open-source components remain subject to their respective licences.
• Licence restrictions may survive termination where required by their terms.

Purchases, Fees & Payment Obligations

Where a product or service requires payment, you agree to pay the applicable charges, taxes, fees, or other amounts stated in the relevant quotation, invoice, checkout flow, subscription, proposal, or agreement.

• Payments must be made through an approved payment method.
• Access to paid services may depend on successful payment and verification.
• Unpaid or disputed amounts may result in restricted access where permitted.
• Refund rights, if any, are governed by the applicable refund policy, product terms, or written agreement.

User Responsibilities

You are responsible for how you use Warke Technologies services, software, platforms, data, accounts, content, and digital resources.

• Provide accurate and lawful information when requested.
• Use the services only for authorized and legitimate purposes.
• Maintain appropriate backups where the service requires user-managed data protection.
• Follow documentation, security guidance, and technical requirements.
• Ensure your own users, staff, or contractors comply with applicable terms where relevant.

Acceptable Use

Use of our platforms and services must comply with the Warke Technologies Acceptable Use Policy and all applicable laws and regulations.

• No unlawful, fraudulent, abusive, deceptive, or malicious activity.
• No unauthorized system access, security bypass, or disruptive behavior.
• No misuse of demos, APIs, downloads, support channels, or infrastructure.
• No infringement of intellectual-property or privacy rights.

User Content, Files & Submissions

If you submit information, files, data, messages, feedback, requirements, media, source code, or other materials to us, you remain responsible for ensuring that you have the right to provide and authorize use of those materials.

• Your submissions must not violate law, contract, confidentiality obligations, or third-party rights.
• You grant us the rights reasonably necessary to process submitted materials for the requested service or interaction.
• Confidential project information remains subject to applicable confidentiality obligations and agreements.

Intellectual Property Rights

Warke Technologies and its licensors retain ownership of trademarks, branding, software, designs, interfaces, documentation, source code, content, frameworks, libraries, internal tools, and other intellectual property except where expressly assigned.

• This Agreement does not transfer ownership unless expressly stated.
• Unauthorized copying, distribution, resale, modification, or commercial exploitation is prohibited.
• Client-specific ownership arrangements are governed by the applicable project or licence agreement.

Third-Party Services & Integrations

Certain Warke Technologies products or services may interact with third-party APIs, cloud platforms, payment providers, hosting companies, communication services, libraries, or external tools.

Third-party services remain subject to their own terms, availability, security, pricing, and privacy practices. Warke Technologies does not control those external services.

Privacy & Data Protection

Personal information associated with your use of our website, products, communications, or services may be processed in accordance with the Warke Technologies Privacy Policy and other applicable notices.

Where Warke Technologies processes data on behalf of a business client, additional data-processing terms may apply.

Support, Updates & Service Availability

Support, maintenance, updates, response times, hosting, and service-level commitments are provided only to the extent stated in the applicable product, subscription, support, maintenance, or project agreement.

• Services may occasionally be unavailable due to maintenance, upgrades, outages, or technical events.
• We may modify or improve services where reasonably necessary.
• No specific service-level commitment applies unless expressly agreed in writing.

Company Representatives & Official Communications

Business discussions, proposals, transactions, support requests, and other commercial communications handled by an authorized representative are conducted on behalf of Warke Technologies and not in the representative’s personal capacity.

• Representative Privacy: Employees, sales personnel, support staff, contractors, and other authorized representatives are not required to disclose personal profiles, private contact information, personal accounts, or other personal communication channels as part of a business engagement.
• Official Verification: Clients seeking reasonable verification may request appropriate company information, official contact details, business documentation, or other credentials made available or approved by Warke Technologies.
• Personal Accounts & Channels: Personal accounts, profiles, contact details, or communication channels belonging to individual representatives are not considered official company channels unless expressly identified or authorized by Warke Technologies for business use.
• Authorized Communications: Quotations, commitments, approvals, representations, or contractual communications will be considered official only when issued by an authorized representative or through a recognized business channel within the scope of the relevant engagement.

Suspension & Termination

Warke Technologies may restrict, suspend, or terminate access where reasonably necessary for security, non-payment, legal compliance, material policy violations, fraud prevention, misuse, or protection of our systems and other users.

• Termination does not remove payment obligations already incurred.
• Certain licence, confidentiality, intellectual-property, and liability provisions may survive termination.
• Where practical and appropriate, users may be given notice or an opportunity to remedy a breach.

Disclaimers

Except where expressly warranted in writing or required by applicable law, services, websites, demonstrations, documentation, and digital resources may be provided on an "as available" basis.

• We do not guarantee uninterrupted or error-free operation in every environment.
• Demonstration environments may not represent final production configurations.
• Compatibility may depend on external platforms, devices, browsers, infrastructure, or third-party services.

Limitation of Liability

To the maximum extent permitted by law, Warke Technologies will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from use of or inability to use the relevant service.

Indemnification

To the extent permitted by applicable law, you may be responsible for claims, losses, damages, or costs arising from unlawful use, unauthorized content, infringement, misuse of services, or material breach of this Agreement.

Any project-specific indemnity obligations contained in a separate written agreement will govern that project.

Governing Law & Dispute Resolution

Unless a separate written agreement specifies otherwise, this User Agreement is governed by the laws of the Republic of India.

• The parties should first attempt to resolve disputes through good-faith communication.
• Where appropriate, negotiation or mediation may be considered before litigation.
• Unresolved disputes may be submitted to competent courts in India, subject to any applicable jurisdiction clause.

Changes to This Agreement

Warke Technologies may update this User Agreement periodically to reflect changes in services, technology, business operations, legal requirements, or platform governance.

Updated versions will be published on this page and may become effective from the stated revision date or as otherwise communicated.

General Provisions

• Severability: If any provision is held invalid or unenforceable, the remaining provisions will continue to apply where legally permitted.
• No Waiver: Failure to enforce a provision immediately does not automatically waive that right.
• Assignment: Rights or obligations may not be transferred where prohibited by the applicable agreement or law.
• Entire Agreement: This User Agreement, together with incorporated policies and applicable service-specific documents, forms the general agreement governing the relevant use.
• Electronic Communications: Notices, approvals, invoices, updates, and contractual communications may be delivered electronically where permitted.
